Labour Relations Board (Nova Scotia) Orders

LABOUR Relations BOARD ORDER 2285: EXCLUDED PARTIES FROM THE BARGAINING UNIT

The following classifications were, by agreement of the parties, excluded from the Bargaining Unit:

(a) President and Vice-President

(b) Deans of Schools; Deans of Faculties, and all other Deans both academic and non-academic

(c) Directors of Schools including but not limited to the Director of the School of Secretarial Science

(d) Provost

(e) Registrar

(f) Chaplain

(g) Faculty Members on the Board of Governors

(h) Directors of the Departments of Extension, Admissions, and Graduate Studies
The status of the following classifications of employees was in dispute and the Board, after considering evidence and argument, decided to include them in the Bargaining Unit:

(1) Heads of Departments
(2) Faculty Members who are members of the Tenure, Promotions and Sabbatical Leave committees

(3) Members for Faculty having permanent tenure

(4) Faculty Members elected to the Senate

(5) Director of Counselling Services

(6) Director of Leisure Studies
The Board indicated that the Director of the Computer Centre, if he did not also hold the position of a full time faculty member, would be excluded. The Board also held that Professors A.B. Cann and R.J. Gerrard are included in the Bargaining Unit.

LABOUR Relations BOARD ORDER 2420: ASSISTANT DEAN

The Board having been satisfied that the classification of Director of the School of Computer Science is excluded by virtue of Section 1 (2) (a) of the Trade Union Act;

AND the Board having been satisfied that the classifications of Professor of Strategic and Military Studies, Assistant Professor of Physical Education and Recreation, and the Assistant Dean of Science are employees within the meaning of the Trade Union Act and have a community of interest within the meaning of Section 24 (14) of the Act with the employees covered by L.R.B. No. 2285, dated July 15, 1976;

the Labour Relations Board (Nova Scotia) does hereby amend L.R.B. No. 2285, dated July 15, 1976, by including in the description of the Bargaining Unit the classifications of Professor of Strategic and Military Studies, Assistant Professor of Physical Education and Recreation, and Assistant Dean of Science.

LABOUR Relations BOARD ORDER 3338: DEMONSTRATORS

the Labour Relations Board (Nova Scotia) does hereby amend L.R.B. No. 2285, dated July 15, 1976, as amended by L.R.B. No. 2420, dated March 7, 1978, by including in the description of the Bargaining Unit the classification of Demonstrators. This Order is to become effective upon the expiration of the subsistent Collective Agreement between the parties.

 

LABOUR RELATIONS BOARD ORDER 3675: LIBRARIANS AND TECHNICAL DIRECTOR OF DRAMA

The Labour Relations Board (Nova Scotia) does hereby amend L.R.B. No. 2285, dated July 15, 1976 as amended by L.R.B. No. 2420, dated March 7, 1978 as amended by L.R.B. No. 3338, dated July 29, 1987 and the current Collective Agreement by including in the description of the Bargaining Unit the classifications of Technical Director in Drama and Professional Librarian except University Librarian. This Order is to become effective upon the expiration of the subsistent Collective Agreement between the parties.

LABOUR RELATIONS BOARD ORDER 4914: PART TIME

The Labour Relations Board (Nova Scotia) does hereby certify the Acadia University Faculty Association, Wolfville, Nova Scotia, as the Bargaining Agent for a Bargaining Unit consisting of all part-time academic staff employed by the Board of Governors of Acadia University of Wolfville, Nova Scotia, pursuant to a letter of appointment from the President or a contract with the Division of Continuing and Distance Education, who provide instruction in at least one university degree credit course, excluding:

1.  The President, Vice Presidents, Deans, Provost, Directors, the Chaplain, and members of the Acadia University Professional, Administrative and Technical Staff (“AUPAT”) who act in a managerial capacity within the meaning of paragraph (a) of subsection 2 of section 2 of the Trade Union Act chapter 475 of the Revised Statutes of Nova Scotia;

2)      For the purposes of this Act, no person shall be deemed to be an employee

a.       who is a manager or superintendent, or any other person who, in the opinion of the Board, is employed in a confidential capacity in matters relating to labour relations or who exercises management functions; or

b.      who is a member of the medical, dental, architectural, engineering or legal profession qualified to practise under the laws of a province and employed in that capacity. R.S., c. 475, s. 2; 2010, c. 37,s.137.

    2.  persons on leave from, or on secondment from, another university, institution, agency or other employer including those holding adjunct, associate, honourary, post-retirement, visiting teaching, or research appointments, or other similar relationships with Acadia University, unless such persons receive remuneration from Acadia University to teach;

    3.  positions covered by an existing collective agreement between the Board of Governors of Acadia University and any trade union;

    4.  persons engaged by reason of professional status or unique qualifications or give occasional or guest lectures or seminars, making up part of a course offered for credit in an academic degree program of Acadia University;

    5.  post-doctoral fellows engaged in teaching to the extent that such teaching is a requirement of their fellowship, and graduate students engaged in teaching to the extent that such teaching is a requirement of a scholarship from an external source;

    6.  teaching assistants;

    7.  coaches in sports programs; and

    8.  persons excluded by paragraphs (a) and (b) of subsection 2 of section 2 of the Trade Union Act chapter 475 of the Revised Statutes of Nova Scotia.

    For clarity (1) the bargaining unit does not include employees of Divinity College (2) the exclusion in paragraph 4 includes positions such as the International Peacekeeping Adviser, the IT Adviser, the Wellness Adviser, the Artist-in-Residence, the Writer-in-Residence and other similar positions.

    LABOUR RELATIONS BOARD ORDER 5093: COMBINING FULL & PART TIME BARGAINING UNITS
    1. Using this approach, the Board is convinced that the part-time instructors at Acadia University do share a community of interest with the academic staff of “full-time” professors, librarians and instructor/demonstrators. As an initial observation, it is significant to note that most bargaining units in unionized work settings encompass a variety of job classifications; indeed, a bargaining unit of a simple classification in a complex work place is highly unusual. Thus, the existing heterogeneous bargaining unit composed of full-time professors, full and part-time librarians, and full and part-time instructors is unexceptional in general labour relations terms. These are academic staff involved in the core teaching and research missions of the university in varying roles. Adding a classification of part-time teaching staff to this general academic bargaining unit would, generally, seem far from anomalous.

     For the reasons attached the Labour Board grants the Amendment of Certification to include the position of Art Gallery Director (“AGD”) in the description of the bargaining unit represented by Acadia University Faculty Association and the Board orders that the terms and conditions of employment of the AGD remain those currently in effect until the expiry of the current Collective Agreement, or until such earlier time as the parties may agree as to an amendment of the Collective Agreement to incorporate different terms and conditions.
